International Law - RES 2625 cited in Nicaragua v US




Nicaragua brought a claim against the United States alleging certain unlawfully military and paramilitary activities against Nicaraguan territory, including the mining of Nicaraguan ports and support for Nicaraguan rebels, the Contras guerrillas against the Nicaraguan government. The United States claimed that the court has no jurisdiction because they had entered a reservation to the jurisdiction of the ICJ excluding a matter from the court if the dispute concerned the application of a multilateral treaty. The relevant treaty here was the UN Charter itself, particularly Article 2(4) on the non-use of force. Nicaragua argued, however, that the court had jurisdiction because its claim against the US was also based on rules of customary law, which although similar in content to the law of the UN Charter, had not been suspended by it. The United States had argued that the rules of general and customary law and those of United Nation Charter are identical.

The Court thus finds that both Parties take the view that the principles as to the use of force incorporated in the United Nations Charter correspond to those found in customary international law employed in Article 2(4) of the United Nations Charter. The Court has however to be satisfied that there exists an opinio juris as to the binding character of such abstention deduced from the attitude of States towards certain General Assembly resolutions, and particularly resolution 2625 (XXV) entitled 'Declaration on Principles of International Law concerning Friendly Relations and Co-operation among States in accordance with the Charter of the United Nations'. The effect of consent to the text of such resolutions cannot be understood as merely that of a 'reiteration or elucidation' of the treaty commitment undertaken in the Charter but it may be understood as an acceptance of the validity of the rules declared by the resolution by themselves.

The court further cited the International Law Commission commentary that 'the law of the Charter concerning the prohibition of the use of force in itself constitutes a conspicuous example of a rule in international law having the character of jus cogens'.

The court, by a vote of 15 to 1 decided that it has jurisdiction to entertain the case brought by Nicaragua against the United States, charging the United States with violation of its obligation under customary international law through use of military force and intervention in Nicaragua’s internal affairs in violation of her sovereignty, territorial integrity and political independence.

Apa method dalam tulisan anda?
Method tulisan? Mcm soalan LRM pulak kan... ala dalam project paper tu... methodology: questionnaire, interview and observation.. Apa yg terlintas di benak ini, yg mampu dizahirkan melalui kata-kata, yg mampu dicetuskan oleh minda yg ketohoran ilmu, yg mampu diterjemahkan kepada English budak skolah menengah, yg tu lah yang saya coret.. Ada antara post lahir daripada imginasi saya yang tak terbatas (sbb sbb itu ia dilabel sbg “Forth Dimension”)...Ada antara post yg lahir dari isi hati manusia dalam cermin.. Apa pun saya memang suka berkongsi dan buat org lain terfikir sejenak walaupu pada benda yg remeh, sbb sekecil2 kuman yg remeh itulah yg membawa sebesar2 wabak.. (big smile)

Getting started




After two months of long break, drowned in sweat and tears, it is time to start the new semester.  Essentially, new semester connotes the expression of new ideas, new missions, new visions and new hopes. Behind these agenda, there lies the need to be mentally and physically prepared. What remains an issue is “the ability to maintain the degree of consistency” (Istiqamah).  

Up till know, I still remember my late grandma, her smile, her jokes and so does her kokeshi, a Japanese wooden doll that she bought for my birthday present when I was 7. My first year at primary school was a nightmare. My mum was right when she mentioned that moving me from Chinese kindergarten to Malay primary school was a mistake. I barely know how to speak in Malay and I had only a few friends. I ate my nasi lemak with my blue plastic chopstick and I always speak Chinese with my mother in public every time she came to school for my report card. Most of the time my schoolmate called me Melayu celup and usually, my grandma was always the person where I turn my face to. When I feel like giving up, she always reminds me about the kokeshi.  

I remain impressed with that wooden doll. No matter how hard and how many times you throw the doll on the floor, it will always stand as it normally does. That reminds me about the adventure of kokeshi warrior in his attempt to bring peace into his land. It’s only after grandma death in 2001, I then realised that she likened me with that myth hero. 

The first 3 days in Shah Alam gonna be an epic. As soon as I step my foot in, I need to clean my apartment and re-organise all my stuff. Then I need to do some shopping for new toiletries and pickup my laundry from the nearby laundry service shop in my neighbourhood I always go. After that I need to re-plant my cactus and get my hair cut. Then I need to consult with the admin in service for my class registration, print the past years final exam questions for every subject and do some check list for my text books and statutes. On the next following day, I need to settle my broadband fee and finish the revision note that I started throughout the semester break. Then I need to prepare the “perjanjian rajin belajar antara aku dan kamu”. 

People say that we will do our best once we had promised to do so with whom we had a bond with. Isn’t? I’m not really sure about it. But I guess it better be as what I previously thought since our previous “azam” had done little effect (haha~). Wish me luck..
